HB 120: Kasey Carpenter’s instate tuition for illegal aliens bill is a fraud – Update: This bill is dead

Update: HB 120 is dead. March 18, 2022 – Crossover Day has come and gone and HB 120 is still back in the House High Ed committee where it was returned last year when it failed to see a floor vote. Unless some Kamikaze legislator tries to attach it to live legislation, Pancho Villa is as viable as this ‘Americans last’ legislation. We were happy to have led the fight.

State Rep Kasey Carpenter (R- Dalton) presented the latest version of his legislation to grant instate tuition to illegal aliens in the House Higher Education Committee last Friday morning. He was on Zoom from his car parked “on the side of the road” somewhere between the Gold Dome and Oklahoma. He was retrieving flour for one of his restaurants.

It got wackier from there.

Carpenter’s opener was to assure all concerned that his legislation rewarding illegal aliens with lower tuition rates than Americans or legal immigrants from most other states pay  “is not a bill about immigration.” He went on to outline HB 120 with “all right, so what this bill does, is it, it, it basically allows DACA students that are in Georgia, they graduated from a Georgia high school, to attend certain colleges and universities in the, in the college system, at an in-state tuition rate.”

‘DACA’ is the acronym for the 2012 Deferred Action for Childhood Arrivals policy put in place by then candidate for reelection, President Barack Obama. The action being deferred is deportation proceedings.

It was more than a little amusing to watch Carpenter pepper his online sales pitch with the terms “DACA” and “DACA recipients.” The same terms were used in the resulting Q&A with gushing Democrat committee members who had only praise for the concept in their questions. It was equally entertaining to see the long line of witnesses – one who is currently a DACA recipient and one who was in the past- stand up in support of the bill inserting the “DACA recipient” term into their testimony.

It was amazing to see that none of the legislators (or the liberal media) seemed to note or care that neither “DACA” nor “DACA recipient” appear anywhere in Carpenter’s tuition amnesty bill.

The entire event would only have been slightly more comical if Rep Carpenter had taken the time to hawk his bill dressed in a wide striped suit with a wink and grin from a used car lot with balloons and a megaphone.

In the current version of his proposed law, Carpenter does have wording that permits illegal aliens to pay less tuition than Americans if they meet “the eligibility criteria set by the United States Department of Homeland Security for deferred action in enforcement of federal immigration laws.”  Italics mine.

But, there doesn’t seem to be set eligibility criteria for deferred action on enforcement – it is a discretionary tradition in federal law enforcement and (like DACA) not a result of congressional action. Lines 34 & 35 in HB 120 would be laughed out of a well-informed committee. ‘Journalists’ should not be running stories that report HB 120 somehow applies to “DACA recipients.” It doesn’t.

Deferred action is not DACA.  Sometimes it is difficult to decide if things that are just plain screwy are a result of ignorance or intent. Deferred action on immigration enforcement is outside of DACA. In the 1970’s, John Lennon obtained deferred action on immigration enforcement. All co-signers are not visible online, but at last check with the House clerk’s office, Carpenter’s instate tuition bill has more Democrat cosponsors than Republicans.

As is, HB120 is a hustle that is fully dependent on the oversupply of immigration ignorance on the part of most of the legislators who govern a state with more “undocumented workers” than live in Arizona. This writer started working with state lawmakers on drafting and perfecting illegal immigration legislation in 2005. HB 120 would not have been allowed a hearing in a Republican – run committee ten years ago.

We were happy to post a very critical analysis of the debut of HB120 along with facts the media is suppressing and fully expected to see changes in the bill as a result.

None of the above is intended to indicate certainty that the bill won’t be passed out of the House Higher Education Committee and onto the floor.

I got a sense of the determination to advance the bill in an early morning discussion with the committee Chairman Chuck Martin (R- Alpharetta) in his office when my request for a copy of any committee substitute language was first dodged then tacitly refused.

The Committee Substitute version presented on Feb 19, 2021 in the Higher Education Committee is not online and will not be posted on the House website unless it is passed out. I have scanned in and posted the paper version (with my scribbled notes) I was given by a friend who was able to get a copy from the Chairman’s staffers.

Here is a link to the original language.  A Fiscal note for HB 120 is available here. It would cost taxpayers a lot of money to provide special treatment to illegal aliens.

Space does not allow a list of all the problems with HB 120. But it should be mentioned that ‘DACA recipients’ are nevertheless illegal aliens according to the United States Court of Appeals for the 11th Circuit. Even the liberal AJC reported that one.

 DACA illegal aliens in GA whould pay less college tuition than U.S. citizens and legal immigrants from other states

Candidate for Lt. Governor and current President Pro Tem of the state senate, Sen. Butch Miller Miller, has come out in support of giving the illegal aliens with DACA a lower tuition rate in public colleges than U.S. citizens and legal immigrants from other states.

Thanks to a Twitter post from an elated  former GALEOstaffer and illegal alien DACA recipient, Jaime Rangel, who lobbies for FWD.us under the Gold Dome (yes, really) we see a January 7 report from the liberal Gainesville Times with that policy nugget.

The Georgia Chamber of Commerce is also pushing hardf or that action.

Boiled down for those new to the issue, there are about twenty thousand illegal aliens living in Georgia with a deferral on deportation proceedings because they came to the U.S. as “children.” That number could soon zoom up because of Biden’s “ya’ll come!” policy on our southern border.

Currently the University System of Georgia (and the Technical College System of Georgia – TCSG) offers essentially two levels of tuition rates – instate and out of state. For academic year 2020-2021, the average tuition & fees for colleges in Georgia was $4,739 for instate and $17,008 for out-of-state according to experts at collegetuition.com. It’s pretty simple: Georgia residents pay less to attend Georgia’s public universities and Tech colleges than a student from Michigan or Arizona, for example.

An Orwellian gimmick: Scratch ‘instate tuition’ and ‘illegal aliens’ – it’s “Opportunity Tuition” and “Opportunity Students” in Georgiafornia #HB120

A version of the below column was posted yesterday (March 8) on the widely read subscription website, Insider Advantage Georgia. It was also sent to every Republican member of the Georgia House early yesterday morning. Yesterday was “Crossover Day” in the Republican-majority Georgia General Assembly, after which any bill that did not pass out of either chamber is dead for the year – unless it is attached to another bill that did cross over. HB 120 was set to pass but an oversupply of education distributed to grassroots GOP voters stopped it.
Americans win one. After much labor,  as of about 10:45 PM March 8, HB 120 is now as dead as Pancho Villa for 2021 (see above caveat).

 

Conservative Georgia voters are “give-me-that-phone” outraged that HB 120 passed out of the Republican-controlled House Higher Education Committee last week. Sponsored by Rep.  Kasey Carpenter, R-Dalton, the bill adjusts Georgia law so illegal aliens pay far less in the public post–secondary education system than Americans and legal immigrants who live in most other states.

It’s being called “equity.” And “workforce development.”

The measure is aimed specifically at recipients of former President Barack Obama’s Deferred Action for Childhood Arrivals (DACA) program. This is notable in that contrary to Carpenter’s previous claims and agenda-driven, inaccurate media reports, the bill as moved actually now does contain a reference to “DACA” for the first time. Including the billionaires at the little-known FWD.us lobbying corporation, Carpenter has widespread and effective support from the usual special interest suspects.  

HB 120 advanced last Thursday by a 16-4 vote in the 25–member committee with all Democrats “present” (it was a ‘hybrid’ meeting) except, apparently, Rep Scott Holcombe. With the exception of Rep Calvin Smyre, they all voted “yes.” Smyre is the Dean of the House. He voted “here.”

Republicans Trey Kelly and David Knight were absent. 

Voting with the Dems were Republicans Carpenter, Clay Pirkle, Dale Washburn, Marcus Wiedower, Rick Williams, Robert Dickey, Bert Reeves and Katie Dempsey. 

The last two names deserve extra attention. Before the vote, Reeves offered public remarks to Carpenter thanking him for his courage and inspiration in sponsoring the illegal alien-friendly legislation and cited un-named “blatant lies” involved in the widespread opposition to the bill. Reeves was not a sponsor of HB 120. 

Dempsey’s “yes” vote appears to reflect a leftward evolution in that she was a co–sponsor of Georgia’s nationally–publicized, pro-enforcement ‘Illegal Immigration Reform and Enforcement Act of 2011 (HB87).

Currently, illegal aliens – including DACA recipients – must pay out-of-state tuition in the public-funded higher education schools that allow them to attend. For academic year 2020-2021, the average tuition & fees for Colleges in Georgia was $4,732 for in-state and $17,060 for out-of-state.

Without so much as a nod to Georgia Orwell, in place of the words “in–state tuition,” the latest language in Carpenter’s HB 120 creates a new tier of charges called “Opportunity Tuition.”  

The new “opportunity tuition” rates for illegal aliens with DACA would be no more than 110 percent of the in–state rate. The illegal alien beneficiaries would be known as “Opportunity Students.”

The gimmick is actually quite ingenious in a Snidely Whiplash sort of way. But we are guessing that an immigrant family in Michigan or New York etc. who obeyed our laws to join the American family will disagree. They may not grasp why they must pay much more for the opportunity to send their kid to Kennesaw State University than a family who illegally jumped a border fence (or overstayed their visitor visa) for the opportunity to live illegally in the Peach State. 

According to DHS, Georgia is home to more illegal aliens than Arizona.

Word is that at least some of the Regents were given the opportunity to learn about the proposed new tuition structure well after Thursday’s committee vote. 

If the House Rules chairman sends HB 120 to the floor, now wide-awake Republican voters will have the opportunity to see how their representatives vote on special treatment for “‘victims of borders” in college tuition. It will be a timely lesson, as there are tens of thousands more on their way right now.

We are sorry to inform you that D.A. King, President and founder of the Dustin Inman Society, has left us.

Donald (“D.A.”) Arthur King, 1 April 1952 – 5 March 2025.

D.A. King left this life and his work for the nation that he loved, confident that he has done his best. D.A. passed on peacefully after a private battle with cancer.

“Once a Marine, always a Marine” – D.A. was always visibly proud of his service and his honorable discharge from the U.S. Marine Corps (1970-1976).
