CIS report: GA leading the way in reduced immigration enforcement – Interior Immigration Enforcement Decline Under Biden: State and Local Statistics 287(g)

Immigration enforcement in the interior of the country has dropped dramatically under President Biden’s policies. These policies have exempted nearly all but the most serious criminal aliens from arrest and removal and have imposed cumbersome new procedures and paperwork for ICE officers to complete cases.¹ According to ICE records, the number of removals nationwide declined from 186,000 in FY 2020 to 59,000 in FY 2021.² Although Biden officials say that the policies were established in order to prioritize the removal of the most serious deportable criminal offenders, in fact the result has been a decline in the removal of criminal aliens as well as other types of cases. For example, the number of removals of convicted felons nationwide dropped from 36,000 in FY 2020 to 27,000 in FY 2021.³

This report presents new information on the decline in ICE enforcement at the state and local level. Using records obtained through a FOIA request, we examine trends in removals of aliens who were identified by ICE under the Secure Communities program. These are removal cases that originate because the alien has been arrested locally for a crime. They do not include border cases, fugitives, worksite arrestees, or other categories of ICE removals. They are a good measure of interior enforcement involving the public-safety-oriented cases that should be a high priority for ICE.

Key Findings:
- Under Biden enforcement priorities, there was a 71 percent decline in removals of deportable aliens who came to ICE’s attention due to a local criminal arrest.
- Ten states experienced an extreme decline in enforcement of greater than 80 percent under Biden policies (Connecticut, Georgia, Idaho, Mississippi, Montana, Nevada, North Dakota, South Carolina, Tennessee, and Vermont).
- Of the 50 U.S. counties that typically have the most criminal alien removals, 14 experienced extreme declines (greater than 80 percent) under Biden policies. About one-third of these high-volume counties are in Texas.
- The high-volume counties with the steepest decline in removals of locally arrested criminals were Gwinnett County, Ga.; Plymouth County, Mass.; Bergen County, N.J.; and Kankakee County, Ill. Criminal removals dropped by more than 90 percent in these jurisdictions.
- There were 50 counties, parishes, or territories with a minimal baseline volume of enforcement where the number of criminal removals dropped by 90 percent or more. Eight of these were in Georgia.
- In one representative county, Howard County, Texas, under Biden policies just half the number of criminals convicted of homicides were removed than before, and there also were steep drops in removals of criminals convicted of assault, burglary, drugs, larceny, and sex offenses….

In September 2003 I set aside my own business and began fighting illegal immigration in Georgia full time. In the years since then we have worked long and hard to draft and pass legislation in our state that would make our state a very difficult place for illegal immigration – if the laws we helped put in place were enforced. Most of them aren’t.

Georgia is home to more illegal aliens than Arizona and more illegals than green card holders.

The “criminal illegals” that Gov. Kemp promised to go after in 2018 are still killing, raping and molesting innocent Georgians. Including our children. A law that requires all jailers in the state to check the immigration status of foreign born inmates is publicly ignored – and the corrupt media remains silent.

We now have sanctuary counties.

E-Verify laws in Georgia are treated as optional in many places.

The push is on by the Georgia Chamber of Commerce and other special interest groups to allow illegal aliens to pay instate tuition in our taxpayer funded colleges while Americans and legal immigrants pay the much higher out-of-state rates.

“I voted” stickers are now given out in multiple foreign languages. Our drivers license test is offered in twelve languages. Illegal aliens work as staff members and lobbyists under the Gold Dome.

Believe it or not, many Establishment Republicans – including some state legislators – are planning another attempt to put illegal alien students in K-12 private school with American taxpayers sponsoring the tuition. This bizarre lunacy would serve to increase the already strong magnet that pulls illegal immigration into Georgia – which is part of the plan.

In 2005, 2007 and 2013 we proudly led the successful state fight against amnesty in Washington, We will always take up that battle. Imagine the state of Georgia today if hundreds of thousands of illegal aliens in the state had been granted U.S. citizenship and the right to vote in the last two elections.

We have two very effective websites on which we put information and issues. I plead with you to make use of them (see below).

I want to continue the resistance in Georgia but long ago ran out of personal funds and am in heavy debt as a result of our work. Donations to our cause have almost completely stopped.

It is humiliating to ask for financial help but that pain is not as bad as standing by and doing nothing while Georgia speeds further down the path to becoming more and more like California. I cannot go on without assistance.

“DREAM Act” amnesty is merely the hook for total amnesty…again

On November 16, Senate Majority Leader Chuck Schumer (D-N.Y.) held a press conference in front of the Capitol in which he called for amnesty for “DREAMers”, aliens brought illegally to the United States as children. As he did so, however, he pulled back the curtain on his end game – to “get a path to citizenship for all 11 million, or however many undocumented, there are here”. The DREAMers are the bait, while a full and total amnesty is the hook.

DREAMers, In Brief. Amnesty legislation for aliens who arrived in their youth has a long, but not particularly successful pedigree. Here’s a brief recap.

In August 2001, then-Sen. Orrin Hatch (R-Utah) introduced a bipartisan “DREAM Act”, which included 18 cosponsors. That bill would have granted amnesty to aliens unlawfully present for five years who entered under the age of 21, and who met certain work and educational requirements.

The timing of that bill could not have been worse, because less than six weeks later, the September 11 attacks showed how foolhardy such blanket amnesties were. Nonetheless, similar “DREAM Acts” were subsequently introduced in later Congresses.

One bears special note. In March 2009, Sen. Richard Durbin (D-Ill.) offered up the “DREAM Act of 2009” during the 111th Congress.

At that time, Barack Obama was president, Democrats held an overwhelming majority in the House, and from September 24, 2009 (when Democrat Paul Kirk was appointed to fill the seat of the late Democratic Massachusetts Sen. Ted Kennedy) through February 4, 2010 (when Republican Scott Brown was elected to fill Kennedy’s seat), Democrats held a filibuster-proof majority of 60 seats in the Senate.

Obama’s fellow Democrats could have passed any bill they wanted – including and in particular the DREAM Act of 2009 – without any Republican votes at all. But that bill went nowhere. Cosponsor and then-Senate Judiciary Chairman Pat Leahy (D-Vt.) did not even bring it up for a vote in committee.

That said, two Republican senators – Mel Martinez (R-Fla.) and Richard Lugar (R-Ind.) – were cosponsors of the DREAM Act of 2009, so they probably would have blocked a filibuster even during the months Democrats only controlled a measly 59 seats in the upper chamber.

Obama blamed Republicans for the failure to pass a DREAM Act, but the fault really lies with him and congressional Democrats alone – DREAM Act legislation simply was not a priority for a party that held a hammerlock on the legislative process.

The popularity of legislation to “protect” the DACA population has been a key talking point for years (I was the punching boy for Democrats at a House hearing on the issue in March 2019), but let’s face it – if it really were all that popular, it would have been a shoo-in in the 111th Congress.

DACA. The failure of DREAM Act legislation led to a program called “Deferred Action for Childhood Arrivals” or DACA. It grants quasi-legal status to aliens who entered the United States while under the age of 16 before June 15, 2007, who are currently under the age of 41, who meet certain educational standards, and have not been convicted of certain crimes.

DACA was not created by Congress, or even by executive order or executive action (for what that is worth). It’s the product of a memo issued by then-DHS Secretary Janet Napolitano on June 15, 2012. In my considered legal opinion, Napolitano lacked the authority to create DACA (the Fifth Circuit ruled in October that the program is unlawful, but the Supreme Court has yet to weigh in), but in any event, it sets a bad precedent.

Want proof? Here’s what the editorial board of the Washington Post had to say when President Obama was considering expanding DACA to include parents of U.S. citizens and lawful permanent residents in 2014:

The president should think twice. Some of the same Democrats and pro-immigrant advocates urging him to protect millions of undocumented immigrants from deportation would be outraged if a Republican president took a similarly selective approach to enforcing the laws — say, those that guarantee voting rights or prohibit employment discrimination.

Obama ignored the Post editorial board and created something called Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA). DAPA proved to be a bridge too far for Texas and several other states, who successfully sued to block its implementation.

Despite all of this, DACA continues, and the Biden administration recently issued a new rule, effective October 31, “to preserve and fortify” the decade-old program.

A Sympathetic Population. The DACA population is admittedly sympathetic. The vast majority of the approximately 650,000 current DACA beneficiaries were removable a decade ago, but in the intervening years they have been living in a quasi-legal status thanks to some questionable administrative actions.

Even President Trump, in his 2018 State of the Union address, offered up a plan to legalize not just DACA recipients but also a total of 1.8 million “DACA-eligible” aliens – more or less the same individuals covered by the DREAM Act…. please read the rest here at the CIS website.

Please send me copies of all documents processed by Carroll County government for the first five bids for county projects (any contract for the physical performance of services) by contractors and the affidavit required by OCGA 13-10-91 before such bids are considered, for the years 2018, 2019, 2020, 2021 and 2022.

Please send me copies of the annual compliance report required in OCGA 13-10-91 filed with the Dept. of Audits and Accounts for the same years as above.

For clarity, I paste in the relevant language from that statute:

“Public employers subject to the requirements of this subsection shall provide an annual report to the Department of Audits and Accounts pursuant to Code Section 50-36-4 as proof of compliance with this subsection. Subject to available funding, the state auditor shall conduct annual compliance audits on a minimum of at least one-half of the reporting agencies and publish the results of such audits annually on the Department of Audits and Accounts’ website on or before September 30.”

Judge strips illegal immigrant of U.S. citizenship

Sheikh Enamur Rahman, who currently lives in New Hampshire with his son, is also subject to a deportation order from years ago.

Rahman moved to New York City from Bangladesh in 1994 on a non-immigrant visa, according to a lengthy court order issued by District Court Judge Paul Barbadoro.

Rahman engaged lawyers with the hopes of securing work authorization. According to the ruling, he followed the advice of lawyers, changed his name and applied for asylum. He obtained a New York driver license and eventually a passport. But he was eventually caught; his first lawyer was indicted for filing more than 5,000 fraudulent immigration applications.

By 1997, Rahman agreed to voluntary deportation. But he then moved to Atlanta, obtained a Georgia driver license under his true name and later married a U.S. citizen.

He obtained permanent legal status in 2004, and in 2007 he became a U.S. citizen. During various interviews and on applications, he did not disclose his use of a false name in New York or the deportation order.

According to the court order, Rahman “by all accounts, remained a citizen in good standing since his naturalization.”

In 2019, however, prosecutors filed complaints against Rahman and sought his deportation. Rahman had said his misrepresentations were not willful and were made on the advice of his lawyer.

“There is no question that Rahman’s failure to disclose his past name constitutes a misrepresentation (of a material fact),” Barbadoro wrote.

Barbardoro revoked Rahman’s citizenship and canceled his certificate of naturalization. He ordered Rahman to hand over any papers indicating his citizenship within 10 days.
