An Orwellian gimmick: Scratch ‘instate tuition’ and ‘illegal aliens’ – it’s “Opportunity Tuition” and “Opportunity Students” in Georgiafornia #HB120

A version of the below column was posted yesterday (March 8) on the widely read subscription website, Insider Advantage Georgia. It was also sent to every Republican member of the Georgia House early yesterday morning. Yesterday was “Crossover Day” in the Republican-majority Georgia General Assembly, after which any bill that did not pass out of either chamber is dead for the year – unless it is attached to another bill that did cross over. HB 120 was set to pass but an oversupply of education distributed to grassroots GOP voters stopped it.
Americans win one. After much labor,  as of about 10:45 PM March 8, HB 120 is now as dead as Pancho Villa for 2021 (see above caveat).

 

Conservative Georgia voters are “give-me-that-phone” outraged that HB 120 passed out of the Republican-controlled House Higher Education Committee last week. Sponsored by Rep.  Kasey Carpenter, R-Dalton, the bill adjusts Georgia law so illegal aliens pay far less in the public post–secondary education system than Americans and legal immigrants who live in most other states.

It’s being called “equity.” And “workforce development.”

The measure is aimed specifically at recipients of former President Barack Obama’s Deferred Action for Childhood Arrivals (DACA) program. This is notable in that contrary to Carpenter’s previous claims and agenda-driven, inaccurate media reports, the bill as moved actually now does contain a reference to “DACA” for the first time. Including the billionaires at the little-known FWD.us lobbying corporation, Carpenter has widespread and effective support from the usual special interest suspects.  

HB 120 advanced last Thursday by a 16-4 vote in the 25–member committee with all Democrats “present” (it was a ‘hybrid’ meeting) except, apparently, Rep Scott Holcombe. With the exception of Rep Calvin Smyre, they all voted “yes.” Smyre is the Dean of the House. He voted “here.”

Republicans Trey Kelly and David Knight were absent. 

Voting with the Dems were Republicans Carpenter, Clay Pirkle, Dale Washburn, Marcus Wiedower, Rick Williams, Robert Dickey, Bert Reeves and Katie Dempsey. 

The last two names deserve extra attention. Before the vote, Reeves offered public remarks to Carpenter thanking him for his courage and inspiration in sponsoring the illegal alien-friendly legislation and cited un-named “blatant lies” involved in the widespread opposition to the bill. Reeves was not a sponsor of HB 120. 

Dempsey’s “yes” vote appears to reflect a leftward evolution in that she was a co–sponsor of Georgia’s nationally–publicized, pro-enforcement ‘Illegal Immigration Reform and Enforcement Act of 2011 (HB87).

Currently, illegal aliens – including DACA recipients – must pay out-of-state tuition in the public-funded higher education schools that allow them to attend. For academic year 2020-2021, the average tuition & fees for Colleges in Georgia was $4,732 for in-state and $17,060 for out-of-state.

Without so much as a nod to Georgia Orwell, in place of the words “in–state tuition,” the latest language in Carpenter’s HB 120 creates a new tier of charges called “Opportunity Tuition.”  

The new “opportunity tuition” rates for illegal aliens with DACA would be no more than 110 percent of the in–state rate. The illegal alien beneficiaries would be known as “Opportunity Students.”

The gimmick is actually quite ingenious in a Snidely Whiplash sort of way. But we are guessing that an immigrant family in Michigan or New York etc. who obeyed our laws to join the American family will disagree. They may not grasp why they must pay much more for the opportunity to send their kid to Kennesaw State University than a family who illegally jumped a border fence (or overstayed their visitor visa) for the opportunity to live illegally in the Peach State. 

According to DHS, Georgia is home to more illegal aliens than Arizona.

Word is that at least some of the Regents were given the opportunity to learn about the proposed new tuition structure well after Thursday’s committee vote. 

If the House Rules chairman sends HB 120 to the floor, now wide-awake Republican voters will have the opportunity to see how their representatives vote on special treatment for “‘victims of borders” in college tuition. It will be a timely lesson, as there are tens of thousands more on their way right now.

The illegal alien lobby hates the term “illegal alien”. They want people to believe it is not a legal or accurate term.

We took a few minutes to illustrate just a few examples of the official use of ”illegal alien.”As is illustrated below, “illegal alien is used by federal law enforcement, in federal law, in Georgia law, presidential Executive Orders, the IRS, and by SCOTUS – including by the “wise Latina” Justice Sonia Sotomayor.

In its 2019 decision that illegal alien DACA recipients are “inadmissible and thus removable under federal law” and not eligible for instate tuition under Georgia law, the 11th Circuit Court of Appeals used the term at least twice in its opinion – example on page 20.

(“The [Supreme] Court has never applied strict scrutiny review to a state law affecting any . . . alienage classifications [except for those involving resident aliens or permanent resident aliens], e.g., illegal aliens, the children of illegal aliens, or nonimmigrant aliens.”).

Border Patrol Agents Rescue Alien Locked in Trunk

Release Date: June 22, 2015

PINE VALLEY, Calif.—U.S. Border Patrol agents arrested two United States citizens near the Interstate 8 checkpoint on Sunday after finding an illegal alien in their car trunk.

Yesterday at approximately 11:45 a.m., agents approached a 1998 Toyota Camry that had pulled over onto the shoulder of Interstate 8. After speaking with the 39-year-old female driver and her 43-year-old male passenger, the agents requested a Border Patrol K-9 team to conduct a cursory sniff of the vehicle.

While waiting for the Border Patrol K-9 team to arrive, the driver consented to a search of the vehicle. Agents opened the trunk and discovered an 18-year-old male inside who was sweating profusely due to the heat. The trunk was not equipped with an internal escape latch and the man was not provided with any water. Agents determined that the man was a Mexican national illegally present in the U.S.

The driver and her passenger were arrested and face Federal charges for human smuggling. Their vehicle was seized by the U.S. Border Patrol.

Last fiscal year, the San Diego Sector apprehended 29,911 people for entering the U.S. illegally.

U.S. Customs and Border Protection is the unified border agency within the Department of Homeland Security charged with the management, control and protection of our nation’s borders at and between the official ports of entry. We find it amusing that the illegal alien lobby wants people to believe that “illegal alien” is not used in federal law but that they also push legislation to remove the term “illegal alien” from federal law.

(1) whose most recent entry into the United States was without inspection, or
(2) whose most recent admission to the United States was as a nonimmigrant and—
(A) whose period of authorized stay as a nonimmigrant expired, or
(B) whose unlawful status was known to the Government,
before the date of the commission of the crime for which the alien is convicted.
(c) Marielito Cubans convicted of a felony
A Marielito Cuban convicted of a felony referred to in subsection (a) of this section is a national of Cuba who—
(1) was allowed by the Attorney General to come to the United States in 1980,
(2) after such arrival committed any violation of State or local law for which a term of imprisonment was imposed, and
(3) at the time of such arrival and at the time of such violation was not an alien lawfully admitted to the United States—
(A) for permanent or temporary residence, or
(B) under the terms of an immigrant visa or a nonimmigrant visa issued,
under the laws of the United States.
(d) Authorization of appropriations
There are authorized to be appropriated such sums as are necessary to carry out the purposes of this section.
(e) “State” defined
The term “State” has the meaning given such term in section 1101 (a)(36) of this title.

Immigration Terms and Definitions Involving Aliens

Immigrant:

An alien who has been granted the right by the USCIS to reside permanently in the United States and to work without restrictions in the United States. Also known as a Lawful Permanent Resident (LPR). All immigrants are eventually issued a “green card” (USCIS Form I-551), which is the evidence of the alien’s LPR status. LPR’s who are awaiting the issuance of their green cards may bear an I-551 stamp in their foreign passports.

Immigrant visas are available for aliens (and their spouses and children) who seek to immigrate based on their job skills. If an alien has the right combination of skills, education, and/or work experience and are otherwise eligible, the alien may be able to live permanently in the United States. Per USCIS, there are five employment-based immigrant visa preferences (categories): EB-1, EB-2, EB-3, EB-4 and EB-5. Refer to the USCIS Permanent Worker web site for more details.

Nonimmigrant:


An alien who has been granted the right by the USCIS to reside temporarily in the United States. Each nonimmigrant is admitted into the United States in the nonimmigrant status, which corresponds to the class of visa with which, or purpose for which, he entered the United States (e.g., a foreign student may enter the United States on an F-1 visa, which corresponds to the F-1 student status in which he was admitted to the United States).

Aliens in some nonimmigrant statuses are allowed to be employed in the United States, and others are not. Some nonimmigrant statuses have rigid time limits for the alien’s stay in the United States, while others do not.

Each nonimmigrant status has rules and guidelines, which must be followed in order for the nonimmigrant to remain “in status.” A nonimmigrant who violates one of these rules or guidelines will fall “out of status.” An nonimmigrant who remains “out of status” for at least 180 days is deportable and will be unable to re-enter the United States for 3 years. A nonimmigrant who remains “out of status” for at least 365 days is deportable and will be unable to re-enter the United States for 10 years.

This Court’s prior cases recognizing that illegal aliens are “persons” protected by the Due Process Clauses of the Fifth and Fourteenth Amendments, which Clauses do not include the phrase “within its jurisdiction,” cannot be distinguished on the asserted ground that persons who have entered the country illegally are not “within the jurisdiction” of a State even if they are present within its boundaries and subject to its laws. Whiting was a United States Supreme Court case which dealt with the question of whether the Legal Arizona Workers Act was invalid under federal statutes, in particular the Immigration Reform and Control Act. On May 26, 2011, the Supreme Court ruled, in a 5-3 decision, that The Legal Arizona Workers Act was not preempted by federal legislation.[2] Justices Roberts, Scalia, Kennedy, Alito and Thomas formed the majority opinion, while Justices Breyer, Ginsburg and Sotomayor formed the minority opinion (with Sotomayor filling her own dissenting opinion); Justice Kagan was recused in the case, because of having a prior role in the case because of her former role as the U.S. Solicitor General…”

  • “Illegal alien was used three (3) times. Once by Justice Sonia Sotomayor. “In her dissent, Justice Sotomayor wrote that the court had interpreted federal law to allow states to “determine for themselves whether someone has employed an unauthorized alien so long as they do so in conjunction with licensing sanctions.” Sotomayor found this interpretation to be irreconcilable with the rest of the federal statute, arguing that Congress intended to reserve the right to make such a determination for the federal government. Only after the federal government had made such a determination could a state impose licensing penalties. Arizona disrupted the federal scheme “prohibiting the employment of illegal aliens in the United States” by making its own determination, and so the provision was therefore preempted by federal law.[7]

ATLANTA — He says the United States is filling up with immigrants who do not respect the law or the American way of life. He refers to Latino groups as “the tribalists,” saying they seek to impose a divisive ethnic agenda. Of his many adversaries, he says: “The illegal alien lobby never changes. It’s the Wall Street wing of the Republican Party joining forces with the Chamber of Commerce, the far left and the Democrats in an effort to expand cheap labor and increase voting for the Democratic Party.”

D. A. King, who quit his job as an insurance agent a decade ago to wage a full-time campaign against illegal immigration in Georgia, is one reason this state rivals Arizona for the toughest legal crackdown in the country. With his Southern manners and seersucker jackets, he works the halls of the gold-domed statehouse, familiar to all, polite and uncompromising.

Now, like other local activists around the country, he is looking beyond Georgia to stop the House of Representatives from following the Senate and passing legislation that would open a path to legal status for illegal immigrants.

As lawmakers return to their home districts for the August recess, advocates like Mr. King are joining forces with national groups that oppose legalization and favor reduced immigration for an all-out populist push.

“These local people live in the middle of these places, they know how to be effective in their districts,” said Roy Beck, executive director of one of the largest national groups, NumbersUSA, who is now holding regular strategy calls with Mr. King and more than 50 other state advocates.

The zeal of militants like Mr. King is a problem for the House speaker, John A. Boehner of Ohio, and other Republican leaders, who are hoping to steer their divided caucus to pass a House version of legislation to fix the broken immigration system, which could include legal status for those who lack it — though probably not citizenship.

Mr. King’s “respectful but firm” message for the speaker, he said in an interview, is that “any vote for legalization would be a matter of very great consequence for the people who voted for conservative congressmen from Georgia.”

Mr. King says his wrath grew slowly, beginning in the 1990s with a feud with Mexican neighbors who disrupted the quiet of his leafy street. In Mr. King’s account, they parked fleets of run-down vehicles on their lawn and at one point housed 22 people in a jerry-built warren of rental rooms in the basement.

He took the neighbor to court over code violations, and the conflict boiled for seven years until the family moved away.

A visit in 2004 to the Southwest border convinced Mr. King that the country was facing “what was easily described as an invasion.” Returning to Georgia, he made common cause with the struggling father of a teenage boy killed in a car accident by a reckless driver who was an illegal immigrant. He named his organization the Dustin Inman Society, after the boy.

The mistrust of Mr. Boehner among Mr. King and his allies deepened recently when the speaker rebuked an anti-amnesty hero, Representative Steve King, Republican of Iowa, for commenting that young immigrants here illegally had “calves the size of cantaloupes” from running drugs across the border.

Mr. King in Georgia said he sided squarely with the congressman of the same name, although he might have chosen a milder metaphor. He nonetheless spared little in his description of Senator Marco Rubio, the Florida Republican who was one of the authors of the Senate bill, calling him a “smarmy and dishonest” turncoat. During the Senate debate, Mr. King designed and paid for thousands of bumper stickers as well as three large billboards along a commuter highway near Atlanta.

“Help us stop RubiObama amnesty!” one big sign read, with President Obama’s name joined by his hallmark red-white-and-blue letter to that of Senator Rubio.

His billboards instructed drivers to call a senator from Georgia, Johnny Isakson. Mr. Isakson, who supported a comprehensive bill in 2007, voted against the Senate legislation this year.

In Georgia, Mr. King has not been afraid to take on many adversaries, including the farmers and growers, business organizations, labor unions and Latinos. A big-shouldered former Marine, he often shows up with his own placards at rallies called by his opponents — just to let them know he is watching.

“I was taught that we have an American culture to which immigrants will assimilate,” Mr. King said. “And I am incredibly resentful that’s not what’s happening anymore.”

Mr. King, 61, runs his one-man operation from the small guest room of his home on a tree-shaded cul-de-sac in the Atlanta suburb of Marietta, equipped with an aging desktop computer and a chair that he acknowledges “needs a new coat of duct tape.” He lives on small donations, and to keep it all going he spent down his savings, ran up his credit cards, refinanced his house three times and “sold the stock my grandmother left me.”

He is unmoved by the protests of Latino and immigrant groups that the Obama administration has already done more than enough enforcement, with more than 1.6 million deportations those groups say have sown fear in their neighborhoods.

Mr. King wants a lot more enforcement before the House does anything else on immigration. He sees the Senate bill as a scheme by Democrats to create legions of new government-dependent voters for their party. He feels certain House Republicans will ultimately reject it.

“The tribalists will not make any difference with any Republican who has enough sense to get on an airplane every Monday and fly to Washington,” Mr. King said.

In his recent meetings in the statehouse, Mr. King huddled with two Republicans, Senator Josh McKoon and Representative Edward Lindsey, who called in by phone. They laid plans for Republicans in the state legislature to send a letter to all the Georgia lawmakers in the House, urging them to focus on enforcement and avoid legalization.

Mr. King is joining a surge of activity among his allies that was spurred by the Senate vote in June. At NumbersUSA, Mr. Beck said, more than 400,000 people signed on to an e-mail list as the vote approached, expanding its followers to more than 1.6 million names. Mr. Beck said a recent conference call he convened with followers was joined by 58,770 people.

But Jerry Gonzalez, a Latino leader in Georgia who is one of Mr. King’s oldest rivals, pointed to new demographics that House lawmakers would have to consider. The number of registered Latino voters in the state grew to 184,000 in 2012 from 10,000 a decade earlier, with more than 200,000 legal immigrants eligible to become citizens.

We are sorry to inform you that D.A. King, President and founder of the Dustin Inman Society, has left us.

Donald (“D.A.”) Arthur King, 1 April 1952 – 5 March 2025.

D.A. King left this life and his work for the nation that he loved, confident that he has done his best. D.A. passed on peacefully after a private battle with cancer.

“Once a Marine, always a Marine” – D.A. was always visibly proud of his service and his honorable discharge from the U.S. Marine Corps (1970-1976).

D.A. described himself as “pro-enforcement” on immigration and borders, an issue on which he dedicated the last 21 years of his life as an expert activist, writer and public speaker.
