Sen Brian Strickland’s SB 107 repaired in House committee – thanks to Chairman Chuck Martin

Many thanks to House Higher Education Committee Chairman Rep Chuck Martin for taking the time to listen to us about the glaring problem on SB 107.

We paste a Tweet from the Senate Press office below as a quick explanation of the bill.

Senators Brian Strickland, Kay Kirkpatrick, Mike Dugan, Butch Miller, and Lee Anderson sponsored the legislation in the state senate.

When SB 107 arrived in the House, Chairman Martin added language that excluded illegal aliens from the incredible benefits of the measure.

Republican voters should ask their own senators why they voted for this in the senate apparently without any thought to our illegal immigration crisis.

We note, not for the first or last time that Georgia is home to more illegal aliens than Arizona and that the southern border is crawling with “unaccompanied alien children (UACs) ” – many of whom will soon be the victims du jour here in Georgia. We did a larger “HELLO!” write-up here.

Illegal immigration: House committee to consider SB 107 and no-cost postsecondary education for foster care students – while Biden has borders open to UACs

SB 107 is scheduled to be heard in the House Higher Education Committee tomorrow, March 17, 2021 at 1:00 PM. This is the same committee that passed out HB 120, the “lower tuition for illegal aliens than Americans” bill that has not yet seen a floor vote.

We suggest changes to SB 107.

Our antenna go up when we see an op-ed embedded in proposed law. SB 107 from Senator Brian Strickland and his cosponsors  is a prime example. Generally, the bill is aimed at providing no cost postsecondary education (*USG (urging language)& TCSG) to young people who have been adopted or are/were in foster care in Georgia. No tuition, no fees.

Here is a sample of the op-ed language in SB 107 – starting on line 15 (LC 49 0418S (SCS))

SECTION 1.  

“Article 12 of Chapter 3 of Title 20 of the Official Code of Georgia Annotated, relating to  postsecondary education grants for foster children and adopted children, is amended by repealing CodeSection20-3-660, relating to program of grants created, terms and conditions, applications, eligibility, duties of the Division of Family and Children Services, expenses and fees covered, and report by the Education Coordinating Council, and enacting a new Code  Section 20-3-660 to read as follows:

(a) It is the policy of the General Assembly that resources of this state should be committed to support benefits and positive outcomes for youth who age out of foster care.

A postsecondary education can benefit these youth, many of whom who have come from  places of great disadvantage; however, too few have been able to realize the benefit.

Therefore, the General Assembly establishes this program to support as many of these  youth as possible in realizing the benefits of postsecondary education. The General Assembly urges and recommends that the Board of Regents adopt substantially similar  tuition waiver programs for these youth to realize the benefits of postsecondary education in the University System of Georgia.”

Georgia ranks number seven in states with its illegal alien population. We are home to more illegal aliens than Arizona – and more illegals than green card holders. We are an illegal alien destination because the state laws put in place to make us inhospitable to illegal immigration are largely ignored by the Republicans in power and because along with the Metro Atlanta Chamber, the Georgia Chamber of Commerce runs most policy decisions under the Gold Dome.

Many of whom are destined to become Georgia residents and likely under foster care, unaccompanied alien children (UACs) are streaming over the southern border as I type because the Democrats are essentially open borders radicals and are fortifying their future voter rolls. It is important to note that last year’s “children in cages” is now “temporary shelters for migrant children…” under Biden.

Already passed in the Republican-controlled senate, SB 107 is scheduled to be heard in the House Higher Education Committee Wednesday, March 17 (tomorrow). It can and should be improved and “illegal alien-proofed.” We have experienced and serious doubts that illegal immigration was any part of consideration in the senate. Senate vote record here.

While we do not claim to be experts on Family and Children’s Services, foster care or adoption, we do know about illegal immigration and that SB 107 is in urgent need of changes.

Fact: Most Georgians will take a dim view of a law that allows illegal aliens to attend post secondary education institutions at no cost while Americans and legal immigrants pay. SB 107 needs a belt and suspenders.

Our suggested changes to SB 107 – sent to some of the Republicans (including the Chairman) on the Higher Ed committee members below.

SB 107  Suggested changes LC 49 0418S (SCS)  

Add sentence that goes something like:

“eligibility for benefits under this code section shall limited to students and applicants who are U.S. citizens, lawful permanent residents as defined by the federal government and foreign nationals who have legal immigration status as determined by federal law…applicants who have deferred action on enforcement of U.S. immigration laws shall not be eligible to apply…”

More suggested changes:

* Line 38 should be changed to include “all of”

code section for each foster child or adopted child who meets all of the following requirements:

* Lines 59 & 60 look very muddy. Should read that student must qualify for FAFSA – not merely complete the application.

* Lines 58-64:

“5) The student completes a simplified application process established by the Division

of Family and Children Services, which shall include completion of the Free Application

for Federal Student Aid (FAFSA) to determine the level of need and eligibility for state  (It looks like illegal aliens d/n qualify for FAFSA, but the bill only says they must complete the FAFSA application – not be approved. Illegals could complete the app, and still receive no cost college?) and federal financial aid programs; provided, however, that a student who is presumptively eligible to participate in the waiver program shall be permitted to provisionally participate in the waiver program for a period of up to 30 days pending the student’s completion of the application process.”

* Starting on line 60, this language should be struck: to determine the level of need and eligibility for state  

and federal financial aid programs; provided, however, that a student who is  

presumptively eligible to participate in the waiver program shall be permitted to  

provisionally participate in the waiver program for a period of up to 30 days pending the

Majority Oppose Amnesty, 73% of Voters Concerned About Border Crisis

A majority of voters are concerned about the current surge of migrants at the U.S.- Mexico border, and oppose plans reportedly being considered by Congress this week to offer amnesty to undocumented immigrants.

A new Rasmussen Reports national telephone and online survey finds that 73% of Likely U.S. Voters are concerned about the government’s ability to handle the growing number of migrants at the border while meeting COVID-19 protocols. That includes 48% who say they are Very Concerned. (To see survey question wording, click here.)

Border crossings have surged since President Joe Biden was elected, and officials in Texas last week expressed alarm at the number of migrants who test positive for the coronavirus and are being released into the United States.

Meanwhile, the House of Representatives is expected to vote this week on two separate amnesty bills that would provide legal status to up to 5 million “undocumented” immigrants.

Fifty-one percent (51%) of Likely Voters oppose such an amnesty plan, including 35% who Strongly Oppose amnesty. Forty-five percent (45%) say they support amnesty for undocumented immigrants, including 22% who Strongly Support it.

The survey of 1,000 U.S. Likely Voters was conducted on March 8-9, 2021 by Rasmussen Reports. The margin of sampling error is +/- 3 percentage points with a 95% level of confidence. Field work for all Rasmussen Reports surveys is conducted by Pulse Opinion Research, LLC. See methodology. This survey was sponsored in part by NumbersUSA Education & Research Foundation. Rasmussen Reports is responsible for all survey questions.

Support for amnesty is highest among Democratic voters, while majorities of Republicans and voters not affiliated with either party are opposed. Sixty-eight percent (68%) of Democrats support legislation to give lifetime work permits and a path to citizenship for an estimated five million undocumented immigrants, including 38% who Strongly Support such legislation. Seventy-two percent (72%) of Republicans are against such an amnesty, including 55% who Strongly Oppose it. Among unaffiliated voters, 55% are opposed to giving lifetime work permits and a path to citizenship for an estimated five million undocumented immigrants, including 36% who are Strongly Opposed.

Despite strong opposition to amnesty among GOP voters, 10 Republican House members have announced their support for H.R. 1306, which would grant amnesty to over 1 million undocumented farm workers and family members.

An Orwellian gimmick: Scratch ‘instate tuition’ and ‘illegal aliens’ – it’s “Opportunity Tuition” and “Opportunity Students” in Georgiafornia #HB120

A version of the below column was posted yesterday (March 8) on the widely read subscription website, Insider Advantage Georgia. It was also sent to every Republican member of the Georgia House early yesterday morning. Yesterday was “Crossover Day” in the Republican-majority Georgia General Assembly, after which any bill that did not pass out of either chamber is dead for the year – unless it is attached to another bill that did cross over. HB 120 was set to pass but an oversupply of education distributed to grassroots GOP voters stopped it.
Americans win one. After much labor,  as of about 10:45 PM March 8, HB 120 is now as dead as Pancho Villa for 2021 (see above caveat).

 

Conservative Georgia voters are “give-me-that-phone” outraged that HB 120 passed out of the Republican-controlled House Higher Education Committee last week. Sponsored by Rep.  Kasey Carpenter, R-Dalton, the bill adjusts Georgia law so illegal aliens pay far less in the public post–secondary education system than Americans and legal immigrants who live in most other states.

It’s being called “equity.” And “workforce development.”

The measure is aimed specifically at recipients of former President Barack Obama’s Deferred Action for Childhood Arrivals (DACA) program. This is notable in that contrary to Carpenter’s previous claims and agenda-driven, inaccurate media reports, the bill as moved actually now does contain a reference to “DACA” for the first time. Including the billionaires at the little-known FWD.us lobbying corporation, Carpenter has widespread and effective support from the usual special interest suspects.  

HB 120 advanced last Thursday by a 16-4 vote in the 25–member committee with all Democrats “present” (it was a ‘hybrid’ meeting) except, apparently, Rep Scott Holcombe. With the exception of Rep Calvin Smyre, they all voted “yes.” Smyre is the Dean of the House. He voted “here.”

Republicans Trey Kelly and David Knight were absent. 

Voting with the Dems were Republicans Carpenter, Clay Pirkle, Dale Washburn, Marcus Wiedower, Rick Williams, Robert Dickey, Bert Reeves and Katie Dempsey. 

The last two names deserve extra attention. Before the vote, Reeves offered public remarks to Carpenter thanking him for his courage and inspiration in sponsoring the illegal alien-friendly legislation and cited un-named “blatant lies” involved in the widespread opposition to the bill. Reeves was not a sponsor of HB 120. 

Dempsey’s “yes” vote appears to reflect a leftward evolution in that she was a co–sponsor of Georgia’s nationally–publicized, pro-enforcement ‘Illegal Immigration Reform and Enforcement Act of 2011 (HB87).

Currently, illegal aliens – including DACA recipients – must pay out-of-state tuition in the public-funded higher education schools that allow them to attend. For academic year 2020-2021, the average tuition & fees for Colleges in Georgia was $4,732 for in-state and $17,060 for out-of-state.

Without so much as a nod to Georgia Orwell, in place of the words “in–state tuition,” the latest language in Carpenter’s HB 120 creates a new tier of charges called “Opportunity Tuition.”  

The new “opportunity tuition” rates for illegal aliens with DACA would be no more than 110 percent of the in–state rate. The illegal alien beneficiaries would be known as “Opportunity Students.”

The gimmick is actually quite ingenious in a Snidely Whiplash sort of way. But we are guessing that an immigrant family in Michigan or New York etc. who obeyed our laws to join the American family will disagree. They may not grasp why they must pay much more for the opportunity to send their kid to Kennesaw State University than a family who illegally jumped a border fence (or overstayed their visitor visa) for the opportunity to live illegally in the Peach State. 

According to DHS, Georgia is home to more illegal aliens than Arizona.

Word is that at least some of the Regents were given the opportunity to learn about the proposed new tuition structure well after Thursday’s committee vote. 

If the House Rules chairman sends HB 120 to the floor, now wide-awake Republican voters will have the opportunity to see how their representatives vote on special treatment for “‘victims of borders” in college tuition. It will be a timely lesson, as there are tens of thousands more on their way right now.

We are sorry to inform you that D.A. King, President and founder of the Dustin Inman Society, has left us.

Donald (“D.A.”) Arthur King, 1 April 1952 – 5 March 2025.

D.A. King left this life and his work for the nation that he loved, confident that he has done his best. D.A. passed on peacefully after a private battle with cancer.

“Once a Marine, always a Marine” – D.A. was always visibly proud of his service and his honorable discharge from the U.S. Marine Corps (1970-1976).

D.A. described himself as “pro-enforcement” on immigration and borders, an issue on which he dedicated the last 21 years of his life as an expert activist, writer and public speaker.
